Terms and Conditions

Purpose

These terms and conditions define the booking arrangements for musical performances offered under the name MIAS Groupe. MIAS Groupe is the trade name used by Maria Isabel Arango Santacoloma, who is self-employed.
Unless otherwise agreed in writing, the client's contracting party is therefore Maria Isabel Arango Santacoloma, and not a separate company. These terms and conditions apply to any request for a musical performance, unless otherwise agreed in writing between the parties.

Booking request

Any request submitted via the contact form, by email, by phone or by any other means constitutes a request for information or a quote. A booking is only considered confirmed once the service provider has given written confirmation and the client has accepted the specific terms of the performance, including the date, venue, planned musical lineup, duration, price and any special conditions.
The individual musicians in the lineup may change depending on availability, provided that the agreed lineup, instrumentation and standard of performance are maintained. A simple request sent via the contact form does not constitute a confirmed booking.

Quotes and pricing

Prices are established by quote, depending in particular on the type of event, the requested lineup, the duration of the performance, the location, the schedule, travel costs and any technical constraints. The quote specifies the services included and, where applicable, additional costs such as travel, accommodation, meals, equipment rental, specific sound equipment or extension of the performance. Unless otherwise stated, the prices provided are valid only for the performance described in the quote.

Payment

Payment terms are specified in the quote or booking confirmation. Unless otherwise agreed, a deposit may be requested to definitively confirm the booking. The balance is payable according to the terms agreed in writing. In the event of late payment, the service provider may send a reminder to the client. If payment remains outstanding despite this reminder, the service provider reserves the right to suspend or cancel the performance, without prejudice to amounts already due.

Client obligations

The client undertakes to provide all information necessary for the proper preparation of the performance, including the exact address of the venue, the schedule, access conditions, on-site contacts and any technical constraints.
The client is responsible for the general organization of the event, obtaining the necessary permits, the safety of the venue, access to the performance area and compliance with applicable regulations, particularly regarding noise, hours, safety and public reception. For outdoor performances, the client must provide a suitable, stable, secure location protected from bad weather.

Technical requirements

Any technical requirements are defined according to the lineup and type of performance. They may concern in particular the stage area, power supply, sound equipment, lighting, access to the venue, parking and set-up time.
If the minimum technical conditions are not met on the day of the event, the service provider will do its best to carry out the performance.
However, it cannot be held liable for reduced quality or inability to perform due to technical conditions that are insufficient, unsafe or that do not match the information agreed upon.

Copyright and SUISA

For public events or events subject to a declaration requirement, the client or organizer is responsible for any procedures, authorizations and royalties related to copyright, particularly with SUISA, unless otherwise agreed in writing. Upon request, the service provider may provide the available information about the musical programme, insofar as required for the organizer’s procedures.

Changes to the performance

Any significant change to the performance after confirmation, in particular a change of date, time, location, duration or musical lineup, must be communicated in writing and accepted by the service provider. Changes may result in a price adjustment, particularly in the event of an extension, additional travel, a change in lineup or specific technical constraints.

Cancellation by the client

Any cancellation must be communicated in writing. Unless otherwise agreed in the quote, the following flat-rate cancellation fees apply:
cancellation more than 60 days before the performance: only costs already incurred may be invoiced;
cancellation between 30 and 60 days before the performance: 30% of the agreed amount is due;
cancellation between 15 and 29 days before the performance: 50% of the agreed amount is due;
cancellation between 7 and 14 days before the performance: 80% of the agreed amount is due;
cancellation less than 7 days before the performance: 100% of the agreed amount is due.

These fees take into account in particular the reserved date, the preparation time, any costs already incurred and the difficulty of replacing a cancelled date at short notice. When the performance can be postponed to a new date agreed by mutual consent, the service provider may waive all or part of the cancellation fees, subject to costs already incurred.

Cancellation or inability of the service provider

In the event of a major impediment, such as illness, accident, force majeure or circumstances beyond its control, the service provider will inform the client as soon as possible. Where possible, a reasonable solution will be proposed, such as postponing the date or providing an equivalent lineup. If no solution can be found, amounts already paid for the performance not carried out will be refunded. No further compensation may be claimed, except in cases of intentional misconduct or gross negligence.

Force majeure

The service provider cannot be held liable for non-performance or partial performance of the service in the event of force majeure or circumstances beyond its control, including severe weather, accident, illness, an administrative ban, a safety issue, a general outage, a natural event, strike, epidemic or any other event making the performance impossible, dangerous or unreasonable. In such a situation, the parties will first seek an equitable solution, in particular postponing the performance to a new date.

Audio, video and photo recording

Unless otherwise agreed, photographs and videos taken by the client or their guests for private purposes are permitted, provided they do not interfere with the smooth running of the performance. Any professional recording, public broadcast, retransmission, commercial use or significant promotional publication requires the prior agreement of the service provider. The service provider may request the removal of published content that would harm its image, its rights or those of the musicians taking part in the performance.

Liability

The service provider undertakes to carry out its performances with care and professionalism. Its liability is limited to direct damages resulting from proven fault in the performance of the service. All liability for indirect damages, loss of profit, loss of business or consequential damages is excluded to the extent permitted by Swiss law. This limitation does not apply in cases of intentional misconduct or gross negligence. The client is liable for damage caused to the equipment, instruments or gear used by the service provider or the musicians, whether caused by the client, their guests, their own service providers or any person under their responsibility.

Data protection

Data submitted as part of a contact or booking request is used solely to respond to the request, prepare the performance, draw up a quote, manage the booking and ensure administrative follow-up. Data is not transmitted to third parties, unless necessary for the performance of the service, for administrative management, or if required by law. Further information may be specified in a data protection statement published separately on the website.
